1. Objet

This Web site is available at “http://power-road.com” (hereinafter referred to as the “Site”). The Site is the owner of Eurovia, a simplified joint-stock company with capital totalling 366, 400,000 euros registered under number 348 866 260 RCS Nanterre, headquartered at 18 Place de l’Europe – 92500 Rueil-Malmaison – France.

The purpose of these Terms and Conditions of Use (hereinafter referred to as “TCU”) is to govern the access, availability and use of the Web site “power-road.com”.

Accessing and browsing the Site constitutes an acceptance of these Terms and Conditions. By accessing the Site, by any means (including computer, mobile, tablet, etc.), the User acknowledges having read said Terms and Conditions, and undertakes to respect them without reservation. „User“ means any person who consults, browses or uses the Site „power-road.com

2. Discharge of Responsibility

The information disseminated on this Web site cannot be considered as a sale or purchase proposal. All products, processes and programs presented on the Web site www.power-road.com may not be offered in each country. The User acknowledges using this information under his exclusive responsibility.

Eurovia is the holder of the domain name power-road.com.

Eurovia is the owner of the rights, titles, and interests on behalf of Eurovia and Power Road. Any use of these names is prohibited without the prior authorization of Eurovia.
This Site is intellectual work. The Site and its content (i.e., each of the components making up the Site: images, sound, text, know-how, graphic elements, etc.) are protected under the French Code of Intellectual Property, and specifically by rights on the intellectual property, drawings and models, as well as trademarks.

The intellectual property rights on the Site and its contents are the exclusive property of Eurovia. Eurovia does not grant any licence or sub-licence on all or part of the content, or any right other than that of using the Site under these TCU.

In accordance with the French Code of Intellectual Property, and, more generally, international treaties and agreements containing provisions for the protection of intellectual rights, you are prohibited from reproducing (for non-personal use), selling, distributing, transmitting, disseminating, adapting, modifying, publishing, communicating fully or partly, in any form whatsoever, the data, presentation of the Site organization or works protected under intellectual property law, which appear on the Web site www.power-road.com without specific and prior written authorization from the holder of the copyright on the work, presentation, or site organization, or the data reproduced.

4. Personal Data

Methods of Collecting Personal Data

Eurovia collects information from visitors to the www.power-road.com Web site through questionnaires that may appear on the Web site (under the Contact section). This information allows to respond to your requests for information.

The personal information that is collected is limited to those that are necessary to contact you  (such as your last name, first name, title of your profession, name and address of your company, e-mail, telephone, fax, and connection data of a non-personal nature). Each message will contain your Web address and any additional information that you would like to include in the message.

You are informed that, during your visits to the Web site, a navigation-tracking mechanism (cookies or other tracers) may be used.

Eurovia undertakes all reasonable measures at its disposal to preserve confidentiality of said personal data.

Purposes of Processing

As an institutional Web site, the purposes of the data collected by Eurovia through the Web site “power-road.com” are as follows:

  • To use an address file for information and external communication purposes following an express request made by the User in the “Contact” section
  • to use connection data for statistical purposes of estimating or Site traffic

The information required by Eurovia to fulfil the purposes described above is indicated by an asterisk (*) on the different pages on the Site. In the absence of such information, access to the services and functions of the Site may be refused.

The other information is of a consultative nature, and allows us to better know the Users and improve our communication.

Retention Period

Personal data shall be retained for the duration required to carry out the different aforementioned purposes, and for a period of thirteen (13) months as of their collection.

Personal data shall be deleted following the occurrence of one of the following events:

  • end of the retention period as specified during the annual update of data collected
  • exercise of the right to removal in accordance with the amended Act dated January 6, 1978, related to data processing, files and freedoms
  • removal of the Site for any reason whatsoever

The data collected by Eurovia may be transmitted to the relevant departments and directorates of the Eurovia Group.

Right to access data

Eurovia would like to remind you that, in accordance with the Act dated January 6, 1978, related to data processing files and freedoms as amended, you have the right to object, and the right to access and correct your personal data. You may exercise these rights at any time by sending a letter specifying your request to:

5. Amendments

The use of the Site is subject to the TCU in effect at the time of use.

Eurovia reserves the right to modify and update the TCU without notice. To be informed of any potential changes, it is recommended that the User regularly re-read the TCU.

6. User Behaviour

The User agrees to respect these TCU.

The User agrees in particular to behave in accordance with all the provisions of this paragraph, specifically to:

  • not use a false identity with the purpose of deceiving others and to inform Eurovia of any false, usurped or erroneous contact information;
  • not harm any person through the Site;
  • not set up a hyperlink to the Site without the prior written authorization of Eurovia;
  • not damage the reputation of Eurovia or other Users via the Site;
  • not disseminate material that is defamatory, abusive, obscene, offensive, violent  or inciting violence, or of a political, racist or xenophobic nature, or that would generally be contrary to the laws and regulations in force or to morality;
  • not to attempt to probe for or test the vulnerability of the Site, or to violate security and authentication measures without authorization;
  • not disrupt or interrupt the Site or servers or networks connected to the Site, or violate the requirements, procedures, rules or regulations of the networks connected to the Site;
  • not attempt to interfere or adversely affect the use of the services proposed by the Site;
  • not disclose unnecessary, sensitive or third-party personal, professional or confidential information;
  • not process any personal data obtained on or via or using the Site, in particular any collection, any misuse and any act likely to infringe on the privacy or reputation of other Users or any other natural or legal person.

Eurovia may, at any time and for any reason, use any means to terminate the use of the Site by the User, without any prior notice, or any or all services provided by the Site for any conduct violating of the TCU, without prejudice to any damages and interest that Eurovia reserves the right to claim from the User in the event of non-compliance with these TCU.

6. Applicable Law and Disputes

These TCU are subject to French law:

Any dispute or disagreement related to the execution or interpretation of these TCU which cannot be settled amicably will be submitted within the jurisdiction of the Court of Appeal of Paris if the User is located in France.
